Contract
No contract exists between you and the Supplier for the sale of any goods until the Supplier has received and accepted your order and the Supplier has received payment in full.
The Supplier may change these terms of sale without notice to you in relation to future sales.
In addition to the price of the goods ordered, you may be required to pay a delivery charge for the goods.
The goods you order will be delivered to the address you give when you place your order. If delivery cannot be made to your address for reasons under the Supplierīs control the Supplier will inform you as soon as possible. The supplier will will not be liable, if delivery cannot be made to your address for reasons out of the Supplierīs control. Every effort will be made to deliver the goods as soon as possible after your order has been accepted. However, the Supplier will not be liable for any loss or damage suffered by you through reasonable or unavoidable delay in delivery.
Minimum and Low Order Value
As we are a wholesaler, the margins on low value orders would not sustain our overheads. We therefore have implemented a low order fee of Ģ5.00 on any order less than Ģ50.00.
Price Match
Our price matching policy refers to identical goods only. ie. same manufacturer and product. It is for UK customers and suppliers only. The competing supplier must have the items in stock. The competing supplier cannot be the manufacturer or the importer of the products into the UK. It is at the discretion of Artsaler management to match the price, and is in no way a binding contract until the order has been accepted by the supplier and paid for by the customer.
Ownership
The goods are at your risk from the time of delivery.
Ownership of the goods shall not pass to you until the Supplier has received in full (in cash or cleared funds) all sums due to it in respect of:
the goods, and
all other sums which are or which become due to the Supplier from you on any account.
Backorders
On placing your order, the system shows which items are not available at the time of order. If items ordered are not in stock, these can be sent out when they come in. If the customer goes ahead with placing the order of items that are not in stock, these items will be put on our backorder system.
If part or all of a backorder can be fulfilled, the supplier will contact the customer to let them know. (The customer can then amend the order to include other items to save on shipping costs.) Adding the items in the initial order will allow the order to be over the Low order handling fee minimum requirement.
Prices of product on backorder cannot be set, and the customer may be asked to pay a different price prior to the backorder being shipped. Should the customer not want to purchase the items at that rate, the customer can then get a refund of any items already paid for.
If shipping charges for the 1st consignment are less than original shipping charges charged on order, because of items on backorder not being sent, the lower shipping charge will be used. Any extra shipping charge on backorders is to be paid at the time of sending out the backorder.
Payment for backorders may be taken at initial placement of the order, or at the time of the backorder being sent. Backorders will not be sent until full payment has been received. (There may be a price difference and / or a shipping charge which must be settled before stock is shipped)
The Supplier shall be entitled to recover payment for the goods even though ownership of any of the goods has not passed from the Supplier.
Liability
If you are a consumer the Supplier shall not be liable to you for any loss or damage in circumstances where:
- there is no breach of a legal duty owed to you by the Supplier or by its employees or agents;
- such loss or damage is not a reasonably foreseeable result of any such breach;
- any increase in loss or damage resulting from breach by you of any term of this contract.

Jurisdiction
These terms of sale and the supply of the goods will be subject to English law and the English courts will have jurisdiction in respect of any dispute arising from the contract, save that consumers resident in Scotland shall have the right to insist upon these terms being construed in accordance with the laws of Scotland and to submit to the jurisdiction of Scottish courts.
